    Why dont you call VFS and find out what's happening and if they can help you to resolve this?

    The VFS website says the consulate is still holding the passport. My wife also applied for H1B on the sameday/sametime and she got her passport within 3 days. I doubt i am stuck because of this new PIMS rule. Should i send an e-mail to the consulate to confirm it?

    It took me around 4 years. EB2 India, started as a scientist later physician and endless headaches ...... but its over now. Got my card yesterday. Its an amazing stress relief and confidence booster.

    I could have tried EB1 too but wasnt sure how it would turn out hence stuck to EB2.

    PD Dec 2005, EB2, RD for 485 Sept 2007. Welcome notice August 5 2008.

    For some odd reason I got a red on this forum. I dont know who did that and why. But I dont care.....

    For those who are waiting: Keep pushing and thinking of new ways of making this work. if you are EB3 try to become EB2 and even EB1. In the end all that matters is getting the card.

    As regards this forum. I never contributed but found this to a good source of information.

    @snathan, sorry pal i thought you must those fake identities in disguise who could pull you back from filing a complaint since they were one from the run, anyways with your suggestion the consular processing i understand there is a chance to come back, but to be true these 3 months have set me back by 3 years, with the consultant not picking my call when i want to ask him about the situation, running from company to company to attend an interview, they all taking a 5-6 hour interview and then then getting back 2 months later only to tell you that
    they had another senior in line from the company for promotion , they gave him the job and no outside candidates are being considered, other companies also making a mockery of the process of hiring. I would be better going to australia and working from within there, yes i did pay for my H1B but to be so true as i want to be i though it was a procedure at the companies and only realized after i had handed it over by reading this forum that i had also become in cohoots with this consultant. I am not a cry baby here , just that people flying in from all parts of the world , India, Australia, Canada and god knows from where, should be made aware that such things could happen to you and beware, for me the beware sign a little late as i believed at first started my research later.

    @poorslumdog when i started to research i found that this company has done this to many Indian guys, many Canadians by charging visa fees and charging some extra dough and sat on it like a vulture, did nothing to call them to the country and some have never reported to work after 3 years of visa filing, now why is this whole tantrum of filing then, they have been expanding with offices in various areas in US and it acts a good mark on
    their company in terms of view from a outside and successful visa filing with candidate money with no responsibility of placing then is a goldmine, they are like half hits in terms of placing and calling people here, i met with an Indian guy who had come here on his own and changed the company finally as he went thru the same scum of this company.
    Seems like there are victims falling for this modus operandi time after time.

    Regarding the 1st point, we, or at least I, am already trying to recruit as many people as I can, also posted IV posters in a few places.
    Does anyone know how the illegals got word out about their rally across the country, or specifically press coverage about it? If so, we can try to use the same source, not for a rally, but to get IV's name out and talk about our major issues reduced to 2-3 points, so it is not confusing for the public.

    Regarding, 2nd point, I think we can all contribute small amounts, say $50-100, but unfortunately most of us are stuck in low paying jobs. If we can get employers involved, that could be a better source of funds. Seriously, I dont expect many employers to contribute, but maybe academic employers who are losing funding because their H1-b employees are not authorized to get it, might be more willing to contribute.

    Also, is anyone aware of any Indian American politicans, perhaps local Congressmen, that we can contact? I think I read recently of one in Texas.

    I agree with rheoretro, the first thing that any member feeling helpless here should do is to get more publicity for IV. Talk to people in the same situation
    who are suffering because of backlog or cannot file because of retrogression.
    Please urge all your friends, influence them to contribute to IV.
    Lets continue doing that on a daily basis and then if you feel you can do more, start writing to your local representatives, senators, house members.
    I have written atleast 2-3 times to my senator on numerous occasions.
    I feel, your words, combined with your thoughts about how this affects you helps a lot in conveying and putting the message across.

    I just got sending a email message to my senator here, I am going to follow it up with a letter.
    Email message reads like this:


    Dear Senator Boxer
    I have been a legal resident in state of " " for close to 5+/X years and I have been a legal resident in the USA for a total of X years.
    I am a legal immigrant, whose application for permanent residency has been pending for the last 3 years.

    The U.S. government makes only a certain number of immigrant visas (green cards) available each year and these are allocated among the various immigrant visa categories and countries from which applicants seek to emigrate.

    Retrogression: For the past few years, the number of immigrants approved for employment-based immigrant visas has been lower than the number of visas available, resulting in no backlog in visa numbers. Recently, the DOS has seen far more immigrants approved for employment-based immigrant visas and has run out of visa numbers in certain categories, causing a temporary backlog or "retrogression" of visa numbers.

    EB-3: This visa category includes employment-based immigrant visas for:

    1) professionals with a bachelor's degree
    2) skilled workers in positions requiring two or more years of experience or training
    3) unskilled workers

    Chargeability: Immigrant visa numbers are further apportioned among the various countries from which applicants seek to emigrate. Each country has a limit and each approved applicant is "charged" against his or her country's limit.

    Also to complicate the matters, there are those folks that came here illegally that were allowed to change status based on 245(i). Every year in Oct (start of new fiscal year for the govt) 140,000 visas are made avaible for EB3s. These 140,000 visas are divided amongst the different nationalities. Some visas are now going to be eaten up by the surge of 245(i)s from 2001. Irrespective of the the nationality of the 245(i) applicants, they are impacting every category witihn EB3. That is the main reason that almost all EB3 categories have retrogressed and will remain so for a while. Its a grim picture but thats the reality.

    We need some intervention from Congress, otherwise people like me will have to wait for years - possibly half a decade or more

    I support your opinion that there cannot be any amnesty for illegal immigrants, but there should be emergency relief for legal immigrants stuck in the logjam for years. We ought to make it a little fair for legal, honest and law-abiding legal immigrants.

    Please support any bill that gives a temporary relief to legal immigrants (especially Employment based applicants). A temporary increase in the number of Visas allocated to the Employment based categories can substantially alievate some hardship.

    why bother about I129 if you have a GC ?

    I'm just keen to find out what's going on, and to get input on whether the I-129 being revoked is anything that can affect the I-140/I-485. I doubt it but would like to be sure. And to share what's going on in my case with others where it may have more of an impact if their H-1B ends up being revoked.

    Anyway, I doubt if it's anything that can't be fixed; my company is very reputable and our attorneys are already engaged.

    Hi Everybody it is a great idea to reimburse aman. Absolutely we have to do it through IV. it is not good idea giving personal checks. what happens when Aman submits his federal taxes. he has to mention everything about the money trail. In America everything should be trailable especially money matters.

    giving money through IV is safe for him and for everybody and there is an accountablity everywhere. As a core member he can collect his administrative costs.

    So whatever the pledge amouts we are doing should be sent to IV then to Aman.

    Any suggestions......

    Ok Logiclife, i did not intend to start a war or anything of the sort. I was just giving suggestions in light of the fact that inspite of IV working VERY hard, nothing is happening on the GC front. That is the ONLY reason I put up this post.

    One more thing. You mentioned that a lot of people are not contributing, maybe the reason is that not everyone wants a GC that desperately. Some people are fine with working here temporarily and then going back after making some money. Besides some members who have contributed in the past may be wondering if it even makes sense to contribute again, being that there has been no real progress on the GC front since Dec 2005 (the birth of IV). Now do not get me wrong I KNOW how hard the IV team has worked and how many time we came SO SO SO close to getting our dreams realized in the Senate only to be crushed in the house again.

    My point was, maybe it is time to face the facts. The government has changed but the basic attitude towards the "immigrant" is the same. This is because the average American, views immigrants as a threat. Now we can argue all we want on that statement, but in our hearts we know that the "AVERAGE American" would rather Not have immigrants come to the US (legal or illegal). In light of these events does it not make sense to ask for simpler goals? Goals like 485 filing or H4 Eads etc. Sure it makes us look weak in front of the anti-immigrants, but then are we here to solve our problems or to prove the anti-immigrants wrong?

    Lastly this was NOT a threat nor was it intended to be a Threat that "take my advice or i will leave". Just a simple suggestion in light of things to come.

    Before I go any further, please read my disclaimer. The views are soley directed towards local market I am aware of and interests in i.e. GMADA ( Punjab/ Chandigarh area) and in no-way should my views/ opionion be applied to flats in Bombay/ Banglore or Hyd etc. With that said, hear me out.

    Their is and last year I first hand expereienced massive infrastrucutral development going on in Delhi as well as in Chandigarh/ Punjab area. Their are supposed to be some Asian or Commonwealth games to happen in 2010. In addition to that, for some great reasons it appears the states closer to national capital had been lacking in basic infrastructural development. Can you believe Bombay-Pune highway is in better conditions than Ludhiana- Delhi, National Highway #1!. FYI: NH-1, is India's historically first highway criss-corssing the country from West to East. So they are playing the catchup game.

    With improved basic infrastructure, living and commuting from satillite cities has become much easier than it was 10 yrs ago. Just like sub-urbs here, people want to enjoy life-style that is un-affordable in city centers. The NRI spending clout has wanned in recent years due to rapid development and growth in India. So the babus, politcians, industrialists, cops, Rich middle-class etc are coming in and taking away most of the RE. In addition to that, the basic infrastrucutral development funded by Government is giving a lot of monies to people whose farming land is being acquired to setup airport or industrial/ residentail sectors. These recently cash-rich farmers are not investing back in buying adjoining farm land but also investing in urban properties. You won't believe, but people were compensated quarter million per acre for recent Mohali/ Chd airport expansion. On top of all this, they ever growing population and shrinking available land is organically raising the prices.

    With all that going, why would you think RE investment would fail? Plus remember the age-old adage "... Land never fails you." Jats do it!

    Numbers USA people are angry right wing citizens.

    Calls from legal aliens who can't vote won't move lawmakers one bit. Money and votes are the only 2 things that matter to politicians.

    Pressure groups and lobbyists have far more reach and influence. IV as a group can use lobbyists and other influence to get a lot more done. Individual phone calls are a waste.

    `(A) the worldwide level of employment-based immigrant visas established for the previous fiscal year; and

    `(B) the number of visas issued under section 203(b), subject to this subsection, during the previous fiscal year.

    `(3) UNUSED VISA NUMBERS FROM FISCAL YEARS 1992 THROUGH 2007- The number computed under this paragraph is the difference, if any, between--

    `(A) the difference, if any, between--

    `(i) the sum of the worldwide levels of employment-based immigrant visas established for each of fiscal years 1992 through 2007; and

    `(ii) the number of visas issued under section 203(b), subject to this subsection, during such fiscal years; and

    `(B) the number of unused visas from fiscal years 1992 through 2007 that were issued after fiscal year 2007 under section 203(b), subject to this subsection.'.

    (c) Effective Date- The amendments made by this section shall take effect on the date which is 60 days after the date of the enactment of this Act.

    Looks like EB visas are recaptured and fed into EB pool.

    Once again pardon me for my ignorance. Is this bill currently active in the senate? or is it the bill introduced last time that you guys are talking about. If it is reintroduced and the substance is as mentioned in the above post, why are we not actively supporting this? If it is infact true IV community should be the one supporting it the most. Senior members please comment.

    we had Infopass appt. IO said your case is pre-adjudicated and under Review. we ask how long will it take to review? He said - doesn't know. can we open SR? He suggested not good to open SR. Reason is they will give same reply - case is under review give us 3 to 6 months. USCIS always tell us to "Not to open SR for Under Review case".     One thing is clear that if our app is in "Under Review", means we have to do something to trigger approval. otherwise it will be in Review forever. we had open SR last yeat september and got same reply in May this year. so SR doesn't work.

    Should Illegal Immigrants Get Tuition Help?

    States' Varying Stances on College-Education Benefit Illustrate Congress's Overhaul Task

    WASHINGTON -- An emotional state-level dispute over college tuition shows how tough it will be for Congress to overhaul immigration laws and extend citizenship benefits to the country's estimated 11 million illegal immigrants.

    Four years ago, California passed a law granting in-state tuition to students who were in the U.S. illegally but had graduated from a California high school. Eight other states followed, allowing illegal immigrants to attend public colleges for in-state student fees -- usually less than half what out-of-state students pay.

    DiAnna Schimek, a Democrat who heads the Nebraska Senate's education committee, says she has pushed for an in-state tuition bill for illegal immigrants as a matter of compassion and economic calculation. "These children didn't bring themselves" but were brought by their parents, she says. "It's only a good investment on our part to make certain they are productive citizens."

    But attitudes have been hardening as an estimated 400,000 illegal immigrants flood in yearly. "That's an alarm to the people here ... it's a drain on the economy," says Rep. Glenn Donnelson, a Utah Republican who heads an education committee in his state.

    So while some legislators want to extend tuition benefits to illegal immigrants in their states, others are calling for laws to deny the benefit -- or take it back.

    Lawmakers in Utah, Kansas and New Mexico -- which passed in-state tuition benefits only two or three years ago -- now are waging uphill fights to repeal them. Massachusetts legislators last month rejected a bill to offer in-state tuition benefits to illegal immigrants.

    Six states are considering measures that would deny in-state tuition, tuition waivers or state scholarships to illegal immigrants. In New York, which offers in-state tuition to illegal immigrants, and Virginia, which recently passed a law offering benefits to some, bills have been introduced to bar illegal immigrants from attending public colleges.

    Meanwhile, lawsuits challenging in-state tuition for illegal immigrants have been filed in California and in Kansas. "There's something wrong with giving a benefit to an illegal that we don't even give to citizens of other states," says state Rep. Becky Hutchins, a Kansas Republican leading a repeal effort there.

    The tuition laws generally require illegal immigrants to have attended a local high school for three years, to have graduated or earned a high-school equivalency and to sign an affidavit promising to legalize their immigration status as soon as they are eligible.

    Promoters expect few students to actually take up the benefit. Dropout rates are high and academic scores generally are low among Hispanics, who account for the majority of illegal aliens. And even in-state tuition, which averages about $5,500 this year, may be out of reach for children whose parents typically hold minimum-wage jobs.

    Kris Kobach, a University of Missouri law professor who brought a federal suit against the Kansas program, says 221 illegal immigrants are enrolled in Kansas public colleges this year, and that even when the benefit becomes widely known, the number probably wouldn't exceed 2,700.

    Even so, in-state tuition laws have become flashpoint among some voters who feel they haven't any other way to protest illegal immigration. Federal laws allow illegal immigrants to use emergency medical services, and a 1982 Supreme Court decision entitles their children to public education through high school.

    Rod Adair, a New Mexico state senator who introduced unsuccessful legislation to repeal his state's immigrant-tuition benefit, says he was acting "in response to my constituents. They're frustrated."

    Prof. Kobach's suit contends Kansas's in-state tuition benefit violates a federal law that prohibits states from giving any benefit to an illegal alien that they don't also extend to all U.S. citizens.

    Among his plaintiffs, Heidi Hydeman, an Iowa native, says she was charged out-of-state tuition by the University of Kansas, though she lived in Kansas for six years and paid Kansas income tax for three years while attending the school. "I thought it was unfair," says Ms. Hydeman.


    Mr. Donnelson, the Utah legislator, says Utah would face a $34 million bill if a similar suit were filed there, and current out-of-state students were refunded the difference between in-state tuition and the nonresident tuition they pay.

    But legislators' doubts go beyond that. Although illegal immigrants who get the tuition benefit pledge to legalize their status, there is almost no way they can do that under current laws. And even with a college degree, there is almost no way for illegal immigrants to legally get a job.

    For years, congressional supporters have promoted a measure, called the Dream Act, that would clear up those problems. States would be allowed to offer in-state tuition to illegal-immigrant students who, in turn, could become citizens.

    In 2003, almost half the Senate cosponsored the Dream Act. But the Dream Act's prospects have faded, and this year its pivotal supporter, Utah Republican Sen. Orrin Hatch, withdrew as a sponsor. "Realistically, the Dream Act will not pass" and should be included in an overhaul of immigration laws, he said.

    But the tensions fueling opposition to in-state tuition laws are the same ones making it hard for Congress to pass immigration overhaul. A coalition of pro-business Republicans, Democrats, immigrant-rights groups and labor unions wants new federal laws that would let illegal immigrants eventually become citizens.

    They are being stymied, however, by social conservatives, who worry about being culturally overwhelmed by immigrants, and by Republican national-security hawks, who are demanding that Washington cut off illegal immigration first.     Now that your H1B from new company has been approved, they must have reopened the old one to send the notice to lawyer requesting them to confirm that you no longer work with them.

    Anyways since ur new H1 is approved you have nothing to worry... chill and Njoy
    This could be possible cos my previous employer told me that they have sent H1B withdrawal letter to USCIS a sometime ago. USCIS might have acted on that request. But we never know.

    I have read my post couple of times before posting to avoid any mis-communication...but it's never possible to prevent I believe:)

    I have a recurring contributions setup and also contributed what ever I could this holidays...probably will contribute more before the end of the season. My post is not about the Monthly contributions made by you, me or many others...who signed up.

    It's about the ones' who cannot for what ever the reason may be....you and me pointing to the salaries or house-hold incomes will not help them join the wagon.

    It's about increasing the donations irrespective of people joining the monthly-contributions scheme....Other viable options...may be having a IV donation boxes...in immigrant owned businesses....etc.

    In an ideal world as you mentioned atleast 20000 of 25000 will contribute monthly....It's defintely good to aim for that....but that's not realistic.
