i know its pretty lame, but what i would really like would be a regular black ipod, and i dont mean that u2 crap, with the wierd red and signatures on the back.
I like the red and black, but I don't like the signatures... I wish it was black all the way around the back. That would be perfect and it *might* actually make me want to get an ipod.

I could not help but to post all my research. i myself recovered money successfully from ex employer.now i am 100% confident that i can handle all claims(only when i am right and have proper documentation) without a lawyer.never file a case in first step.this is how one can go.....
1) complain to State DOL (not federal dol) with the one page filled form and required documents.i faxed the form at 9pm in the night and next morning at 8:30 am i got a call from the investigator to verify my complaint.i said yes.by afternoon he called the employer and asked abt the complaint.at that time my state had only 2 investigators for whole state but see the quick response.i asked investigator how he is going to proceed.he said over 80% are solved on phone.this is how they do it.the investigator calls employer and says i received complaint like this and do u accept or not.if u do not accept we have to come to ur office and look at all the records.if we find more violations we will issue 100$(my state had this fee) for each violation.if u accept u have to pay 100$ for this violation....take a guess what the employer says....by next day afternoon investigation was done.then state dol sends violation notice to employer and employer pays that.after 1 week i got complete documents of the investigation and a letter saying this will help in ur civil case to recover money.
2) i waited for some time to give my employer time if he is going to give my money.but i did not get.next thing i did is went to federal dol Wage and hour(W&H) office which was near to my home.u have to remember federal dol w&H works different from state dol.state dol investigates and imposes fine etc and sends all the resulting documents to u.federal dol w&h takes the complaint and works to settle the wages between u and employer.for my case employer was willing to pay 5 times less than what i was supposed to get.dol w&h called me and said r u willing to settle for this amount.i said no and i will go to court.again i got the documents after 2 or 3 days.
3) here u have option to go to court to file a civil case or complain to ICE.ICE is little serious thing and i thought i will do that if i run out all my options.
4) filing a civil case in small claims court is very easy if u follow right steps.u have to know company exact info as per secretary of state filing. search secretary of state "ur state" in google and u will get ur state secretary of state web site. search the company name and find ur exact company name, agent name and address.
also,u have to file in the same county where ur employer is in or if ur employer is out of state u might file where u r working(some like that).i would ask the clerk whether i can file this case here.if its wrong county,ur case disposition will be rejected.u will waste fees and u have to file again in right county.even though i found all the info and asked the clerk 5 times, she told me the wrong info.ofcourse i recovered that money too.each state has limit on small claims court.mine was like 7000$ and 7500$ was the limit. as per the law if u did not get ur salary within 48hrs or the next pay date of the company u r entitled to get 3 times what u r owed.u need to write a letter saying why u r filing and how much u want.this letter is very important and write what documents proof u have.i wrote dol investigation was already done and i have all the documents proof and hence i am claiming 21,000$ as per the law.since small claims court has 7500$ limited, judge will give u 7500$ when u win the case.after filing the case employer will have 30 days and mine was settled out of court for the full amount he owed including the court costs.if the amount is more than small claims court amount u can file in appeals court.u can defend ur self and no need of attorney as DOL already completed investigation successfully in favor of u.there is no way employer can deny the dol investigation results.
5) if going to court is too intimidating go for ICE and ice does all the work for u.but ICE is a very serious organization and u know the rest.....
do not communicate with the employer by phone or by in person.if u want, communicate thru e-mail as there will be proof and be very courteous, professional as if u r the victim.keep all the e-mails and replies if at all u go to court and show the judge.judges always gives benefit of doubt to employee in these cases and to tenants in landlord-tenant cases regarding lease, deposits etc.
the negative thing abt going to court in the first step is u do not have proof that ur employer did not give checks.usually employers run the pay roll regularly but they do not give u the checks.they save all those checks with the right date when u were supposed to get but they do not give.when u go to the court in first step what they do is show copies of those checks and tell the judge i gave the checks on time and u did not deposit.the burden is on the employee to deposit the checks on right time.so,basically u r screwed at that time.all these employers know that.that is why u have to be calm and diligent so that u do not do this silly mistake.
this is how i went and i read a lot on the internet before doing.hope this helps.please do research and act accordingly as each case may differ...
I am not an attorney...i am just an immigrant stuck in GC Q like u guys....

Folks don't get me wrong, i understand what you guys are going through. my family and close friends are in same limbo. and if any of you has spouse on H4 you will surely know the wonderful status it is to be in. All i am saying is, if there is too much demand for something, there will be a price attached to it. A British can get US gc faster then a Indian cause there are not that many british who wanna come here. and Since USCIS knows we are almost on our knees, they treat us like dirt. Once the demand goes down and more and more Indians will start to look else where, they will start treating us with respect too. Case in pint china, track its history with USCIS, Chinese no longer flock to US, in fact its US who now depends on Chinese money and all and treats its citizens with respect.

IV tracker shows 3000+ EB3-I applicants, however, it is not a good tool to make analysis off of. The sorting function does not consider month-year combo. Anybody knows how to download the data to run your own post processing??
The tracker has more than 6000 entries with missing "Nationality" and "Country of Chargeability" filelds for EB3 applicants. Assuming the majority to be from India, the actual EB3-I entries may exceed well over 9000 and it is a pretty good sample size.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

I just sent in my third $50 thru paypal. I wish I could contribute more. I am likely to come to bench soon and not in a position to do so. I feel bad...sorry guys.
As black_logs said, there is nothing to feel bad about. Out of the 3,000 members of our organization, less than 800 people have contributed money. So feel happy that you are contributing to the maximum extent that you are able to.

Nicely said.
Don't know if it was Roman or greek, but they kept on diluting their currency (gold coins) with copper to support their spending and populist schemes. They kept on diluting to the extent that even India stopped exporting spices becuase their coins were not worth as much as they use to once upon a time.
This is what is happening to dollar.
America is loosing their grips pn global financial system. Even though it will be remembered as the founder of free maket, it has rushed too fast and forced other countries to open up their financial system. HOwever, three essential ingedients of free market theory have not been handled well.
Price discovey, Capital allocation and Flow of liquidity.
We are at a point, where all countries can reject free market as a failed attempt or pick it up from here and strengthen it going foward. Regulation is a must or else we will hit the bump again in future.
Without a proper trading system and regulator price discovey is vey hard and bubbles keep occuring.
This is vey true in case of real estate poperties. There are many localities in Hyderabad where propeties have not been priced appropriately.
In a matter of 1 year, property prices in some localities have gone up multi fold just because of 1 or 2 transactions by desparate buyers.
There is no price differential between 100 sq yards propety or 1000 sq yards property on a per sq yard price basis.
ROE is far greater on investments made on proportionate basis on 1000 sq yard plot compared to 100 sq yard plot. Without regards fo town planning, return on investments every piece of land was priced with the same yard stick.
I think it is best to follow the quotes below
"When eveybody is buying, something is definitely wrong."
"When everybody is selling, again something is wrong".
I don't know much about buying house/property in India. Maybe you want to have a close family member keep an eye on your property otherwise a land graber/local gunda in the area may take possession of your property while you are here/away.
But I find some of the discussion in this thread extremely intriguing. There were specific conditions in 1930s, 1960s, 1990s that caused recovery in those times. Leadership & American generation were ready to sacrifice and do hard work. Contrary to the hard work done during those times, large percentage of the current population is indifferent and does not care to know about the current crisis, not knowing the gravity of the situation. Majority of the population was, still is, opposed to $700 billion bailout/rescue not knowing what is going on. The ups and downs in the stock market is just the beginning. Coming year is going to be very tough, specially on folks are in the situation that require them to visit this forum every now and then.
Every great and prosperous nation is just one generation away from losing its greatness. History teaches us that Great nations lost their greatness/cease to exist because the larger populations ignored the times of crisis. Most people say that America has always come out of crisis in the past and just like those times, America will again come out of the current crisis. That's what everybody expect and wants to see happen, as if there will be a miracle and everything will get fixed. Everybody including media/leadership are taking things for granted, as if things will turn around by itself just because things have turned around in the past. But this apathy is very dangerous. Here is why - we can say with fair bit of certainty that Romans must have also said during their time of crisis that things will be fine, they have always gotten fine because we are the Romans, the empire of Gods, or whatever. Likewise, this time around, media/leaders are guided by similar rhetoric. I find this behavior very dangerous. In 1930s/60s/90s there was able leadership and American generations during those times were ready to do their share. It doesn't appear such this time, atleast not right now. Maybe we have sometime to come out of the crisis and things will change in the near future. But without change in the direction, things don't look very good right now.
Rome was not built in one day and it did not perish in one day. If leadership and population continue to ignore the gravity of the crisis, there is only one possible outcome.
The positive aspect this time around is, due to globalization, other nations have stake in American economy and are willing to come to the rescue. Even nations like China and Russia are willing to step-up. This would have been unthinkable in an un-globalized world. But other nations can only do so much. Ultimately, the larger population in America will have to step up, and that includes us, there is no other way. Now G-7 is working together to come up with a comprehensive plan. A lot of people beat down on globalization, but till now it is working as was designed, which is good, and other friendlier/unfriendlier nations are willing to step-up.
Another foreseeable opportunity to fight the current situation is, world energy crisis. America can use the world energy crisis to turn things around, not necessarily subscribing to ideas from businessmen like T Bone Pickens/natural gas to promote their business and blah bhah blah, but something else, which makes America - a leader to solve the energy requirements of over 6 billion people, when estimated 20% of the world population consumes 95% of the world energy.
I don't know if you should buy property in India or if you should buy gold. But in the grand scheme of things, if I were you, I would hang on to the "cash" very close to my chest. Things are really bad, a lot more than what meets the eye or what is apparent.

In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?
Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.
So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...

My 2 cents..
I voted for both questions. What I believe is, next time we can rephrase the qeustion as gjoe mentioned earlier.
If some one can find a debate questions bit earlier and let all of us know, then we can make rephrased question to the top of the list.

But advocates for skilled immigrantsmany of whom remain stuck for years on H-1Bs waiting in the long queue for permanent residencyworry that the bill is a political maneuver rather than an earnest effort at reform. Aman Kapoor, president of the skilled immigrant advocate group Immigration Voice, says that a more effective bill would ensure H-1B visa workers are on a level playing field with U.S. workers. "Skilled immigrants on H-1Bs don't get the same rights and protections as everyone else," says Kapoor. "So wouldn't the solution be to empower and enable the skilled immigrants on H-1Bs such thatskilled immigrants on H-1s have adequate protections so that no one can take advantage of [them]? But no one wants to talk about protections for skilled immigrants."

Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.
OOPS, we need an amendment to change the effective date, Damn.
