I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

There is vast difference between US and Indian housing market crash. India RE market will not collapse like here. There may be a melt down or small correction. The simple big reason is demand for housing in middle class due to economic growth. Based on population density, US is 9 times bigger than India. Lot of land in US. But housing land is so limited in India. So there is always demand. Second reason, there is no sub-prime lending in India. Third, in India, housing loan is based on cash worthiness rather than credit worthyness like in US. So we may not see such a massive foreclosure/bankrupcy in India to bring the price down considerably like in US.
However, now the prices or extremly high, such that it can not be affordabe to people other than NRI or IT folks. 1 crore houses are very common now. Based on US economy it will definitly come down. It will be depend on how hard IT/outsourcing bussiness gets affectd in future.

If you are from any metros in India, think how many of your Non-IT, mainstream friends draw more than Rs. 50,000 per month? How can someone making even Rs. 50,000 a month afford 50 Lakh flat?
If there are 10 people drooling out side Ferrari showroom that does not mean there is demand for 10 Ferrari :)

Wanted to let those interested know that my 140 EB2 got approved yesterday after RFE.
The RFE was on educational grounds. I have a 5 year integrated Msc in Physics and was -how a degree in Physics is equivalent to computer Science.
My attorney submitted a detailed analysis of all the course and a fresh educational evaluation on the 28th and it got approved on 30th.

Can you please elaborate your case as a CP like how you opted for CP and how long you have been waiting? I have applied for 485 and my PD is 2006, so out of question my date will be current soon but i would like to go back to india to take care of my parents and then when my PD is current I can come back.

Well, I have been waiting for over 5 yrs now. My case is a simple CP case, I was stuck in BEC, till June. The BEC wait frustrated me, so I had decided I would go for CP wouldn't like to wait for name check and the rest of the waits which comes with 485 filing. For that I had to forgo the luxury of EADs, AC21's and AP. Opted for CP during 140 filing, premium processing of 140 was still there during those times.Finished with that in 4 days and my file moved to NVC and from there to Mumbai consulate in October, and from then I've been waiting!!! Hopefully, I get an Interview date this April. And throughout the process I've been in this country, not India, since its EB category, so that aswers your question regarding moving back to India and coming back when PD is current.

Wife and I attended H1 visa interview on Dec'13th, I got passport in 1 week, haven't received passport for wife. Consular staff very rude, say her petition details are not in their system so have to wait. They hang up phone as we are following up everyday. They say 4-5 days everytime we call them

When employees post for job, they might say �need a citizen or gc holder�. But never say we only need a H1-B holder. So when we have respected and followed the rules of this country immigration becomes a right as logic life suggested.

These types of employment advertisements are discriminatory and are thus illegal unless it is work that requires security clearance. I am surprised that the Department of Justice is going after employers (http://www.immigration.com/newsletter1/doj_investigation.html) who may have advertised jobs for non citizens while not going after the numerous advertisements that discriminate against non US citizens. I am aware of atleast one high profile company that engages in this type of activity in its advertisements (however one needs to apply and be rejected in order to file a complaint). The double standard is indeed disturbing :

I saw posts quite similar to my situation so didnt start a new thread but instead thought of using this thread to ask my question.
My situation is
I have my EAD and AP, and my 3 year extension is already approved but H1 stamp has expired.
My wife has used EAD and her H4 extension came before she stopped working on EAD. But she does have 3 year H4 extension too with an expired H4 stamp.
Now we plan on travelling to India next week and i am kind of confused as to whether we should go for H1-H4 stamping or not, or should we use AP to come back.
I have read in so many threads and forums that even if you enter on AP, ur H1 status is valid.
Now if my wife goes for H4 stamping, will the imigration officer consider her under H4 or AOS as she has used her EAD?
Since i have 1 month to come back to US, I am scared if for any reason Immi officer might take time to stamp visa on our passport and we might not make it back to US in time. And also what if they ask all questions regarding GC.
Has anyone gone through the same situation?
SInce these days, mostly all companies are hiring people who have EAD, sometimes i think what is the need to maintain H1 then.
Another thing is that i am not full time employed with my client, so when my project expires, i can find a new company and get my H1B-H4 transfered and that will change my Status from Parolee to H1b again.
So looking at all this, i think even if i come on AP, everything should work out fine for me.

I am willing to play a more active part in this if you can utilise me in anyway. I live in Redmond WA and my wife works in a major software company. I will be completing my 6 years on H1 early next month so I should have plenty of time on my hands. I was working full time in a processor company as a Hardware Design Engineer, most of these 6 years..but unfortunately my GC with them wasn't going anywhere so we decided to move from Austin to Seattle a year and a half back. We didn't envision the retro problem in the Eb2 category and just missed the bus as our PERM filing(from my wife's employer) was a tad too late. My H1 was initially expiring in June so I thought it was too late to apply last year when I saw the retro in EB2. I wish I had applied for my GC somewhere at that stage as I was able to recapture some time on my H and also the I140 filings seem to be a lot quicker this year.
But whats gone is gone....truth of the matter is that I will have to wait for the backlog to clear up...which could take years without legislation.
I would like to play a more active role with trying to garner support for the Skill bill, so please let me know if I can help with anything.
