reasons...
I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

I want to give some fraud and abuse examples. Unfortunately, there are some bad apples in the H-1B visa program.
From The Grassley Visa Tax (http://immigrationvoice.org/forum/showpost.php?p=191337&postcount=1383) The Wall Street Journal Editorial, November 2, 2007
Department of Labor investigations reveal that some 90% of violations are paperwork offenses and good-faith misunderstandings.

Hi Mirchiseth,
Thanks for sharing the Info on your Case.
This is Indeed a very good news.
So far we have 2 Successful Cases wherein H1B Transfer was done
Successfully after Candidate Entered US on Advance Parole.
Hi All
I have been following this thread for the last few days and wanted to share some info. Hoping it would be useful.
I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.
We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.
So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.

I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)
Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.
Hope this helps.
Thank you for sharing this useful information with the rest of us.

@bugs
Yes i do have the entire H1B application in originals with LCA and offer letter from employer
@HRPRO
Yes friend i have decided to go back , and i am not looking anymore i will rather have this energy saved for myself finding jobs in my homeground again
However does anyone have the first hand experience of reporting to DOL, please share your experience too with the kind of paperwork that should aid your application.

I was just kidding on that. I would be more than Happy to see an EB3-I get GC before me with just even a day ahead of me. They are equally deserving.
On that, let's shake hands.. and keep up our friendly kidding.. it's a welcome change for our environment here in IV

I agree. I feel that the only thing that would be acheived if IV became a paid website is loss of membership. Then our PR documents will start with "IV is an organization of 200 members who are affected by ... "

Since Visa numbers trickle down, the more visa numbers there are available, the more will trickle down to countries with high demand... recapturing visa numbers might be easier than taking a poke at per country limit.. IMHO...
I am thinking about future generations as well.
1) Remove per country cap.
2) Remove dependant number count
Recapture of visas is good but its only 1 time thing. Unless its automatic recapture by law.

AC21 doesn't contradict any law. AC21 memo is a real memo. It provides guidance for areas that are not clearly defined. So no point in comparing AC21 memo against the latest illegal memo by USCIS.
>> AC21 memo is a real memo.
Wow, what an ignorance. May I ask, what do you mean by "real memo".
Read previous post and get enlightened. I can't believe that you guys even don't have distinctions about law, CFR, and memos.
AC-21 is law.
Hope it helps.

Keeping our differences on Alexander asides :), thanks for doing the right thing. I greatly appreciate you doing it though you don't live in Michigan.
I totally agree with you on this hypocrite Lou Dobbs and also admire your determination and sticking to your views. I too belive that we can make a change if we are determined. I have written my views to the radio station eventhough I don't listen to that channel as I live somewhere far. I hate to side track the issue but I couldn't control my self to accept that Alexander was great( that apprears in your posts) I stongly belive that he was not great but was a coward (I came to conclusion after reviewing the history)

I looked at the pdf briefly but did not completely understand what changes are proposed for H1b in the bill.
Below are some per my understanding. And also below are questions.
1) Now it looks like H1b requires PERM type recruitment. Is it only for new H1bs or also for extensions & Transfers?? Most of us are already in our 7th/8th year extensions and some others are in 9th & 10th years. It will impact further extensions or transfers and will jeopardize our GC process.
2) These changes would unnecessarily scare away genuine employers as it is like a mini- GC perm process. They may settle for an unqualified or less qualified citizen instead of hiring a highly qualified H1b suitable for the job.

To answer your question
"Do they enter a validity date on I94 when we enter using AP ? If so what date would that be ?"
The expiration on the new I-94 after using AP is 1 year from the time the AP is used and not related to AP expiration date from my experience.
The I-94 date I received was 6 months beyond my AP expiration.

Why do you bring Malice with you, everywhere, seriosly how does your family stand you ?
I have seen your posts earlier, they are full of abuses, unjust full of most useless comments, let me tell you one thing, it is a very well known truth people who are most abusive on cyber space, are most fattoo & have been beaten up kind of people because they spend their life in threat but on cyberspace they become Lion. You are a typical Cyber Sher... But in real life I can guess....
well, regardless of what sanju said, this response of yours is totally uncalled for.
THis gives me a feeling that members on IV who are contributors and or are volunteers/activists are getting their way with foul language on this forum.
And Sanjus last post loudly mentions that. So sanju, you being a helper to the community gives you a right to speak and behave anyway you want?
Mods are simply looking the other way. by simply deleting his posts full of foul language.
