I don't think you have waited for 6 years after your PD to be able to file for EAD/AOS Benefits... the whole thing is messed up... There are people who filed during July Bulletin Fiasco and there are who could not even though their PDs are before yours. So do you ask them to SHUT UP ?

Dear Mr. pascal,
Given that you are the super moderator, how can you even hint that EB3 vs EB2 reflect skill level of employee - don't you know by now that category is determined by "job's Requirement"?!!!!!!
Also your stereotyping of all EB3s as 3 year Indian degree holder is the most unfortunate - I only hope that rest of the IV leadership is not made up of that crappy idea.
For the record, I hold US Master's degree and am really offended by your comment and your view point.

Nss you really have some problem for which you should seek professional help. I am EB2, but I don't go around wining, why I am not EB1, yes the word is winning. I told you yesterday, we didn't make the system and yes I will take the credits for being EB2 because I worked diligently for it, taking student loans and working professional job.
And that job title crap, take it somewhere else, because if that was the case there wouldn't be any Masters or PHD level education, neither there would be STEM. Give credits to our fellow members who come here and work diligently to gain higher education.
And yes, I am sure lot of people will concur with me, the Indian body shop companies, who bring a lot of people from India, abuse the H1b system and file green cards. The EB3 category is a abyss of applications filed for these type of cases.
Next time when you want to argue, keep your facts clear and handy.

I remember the IO asking my spouse about being a member of a job-related professional association. My spouse used to be a member of such an organization and mentioned so. The IO then remarked that such membership is a requirement for such kind of a job. She then just let it go, however.

If you're worried, the easiest thing to do is to have the name changed in the passport. The Consulate doesn't ask for any questions and issues the new passport within a day. For my friend, the first name and the last name were interchanged and getting the new passport was a breeze.

To begin with, Congratulations to every deserving IV member who can now apply for a green card!
I'd like to thank each and every member of the IV Core Team. Your efforts have changed our lives. Because of you, people won't be scooting off to UK and Canada, some children won't age out, people wouldn't have to get more *ouch!* shots, et al! From skepticism to total admiration is how my perception of IV changed over the past two weeks. You have done justice to the name Immigration Voice. Enough said!
Like the Core Team repeatedly insists, this is just one of the first few important steps, and there is a lot more to be done. And for that to happen, IV needs contributions. I am not in a position to urge people to contribute. I am a junior member, 20 years old, on an H-4 with no means to work, and not a single bank account yet to my name. However, I wish to pledge the first 500 hundred dollars of savings from my first job after obtaining an EAD to Immigration Voice.

Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.
For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.
Since time is short this time, we need all the stories from each state to make our case.
As promised, we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be noticed by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
We will just concentrate on the crux how you are suffering because of delays such that even if your boss reads this story, he will not be offended or put off (Read our members stories in the three articles I have mentioned, none of it can get the IV members in any trouble at all).
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.
But please send in your stories so we have a convincing story to make our case.....

Thank you to all members here and core members. I have been watching this thread since June 30. I can't believe this is actually happening.
I was the one who DID NOT send any flowers because I was simply scared.
I was the one who DID NOT contribute any donation to IV.
I was the one who wouldn't do rally, simply I did not think it's gonna work.
Now, I am very happy. At the same time, I shame myself.
Once again, I bow to all members who actually did something & contributed something to this community and entire legal immigrants. I will remember this day even when I get a citizenship in the future.
Finally, I like to make a donation to this community. However, let me finish my I-485 filing NOW! lol gotta send this to my laywer tomorrow morning...

my reply was only meant to highlight what you have been doing on this thread. i do not care who is in which EB category. and i know exactly how people with masters degrees suffer in EB3. however, for you to argue that all category preference should just disappear, is quite ridiculous and i have explained the reasons to you. that does not mean people in EB3 are not suffering or that all those in EB3 are either holding advanced degrees or 3 year bachelor degrees. that stereotyping is in your head alone. certainly not in mine. you never answered any of my questions though. what would be the effect of YOUR solutions? would people like me EVER get a GC?

as for STEM exemption, if EB2 clears up, where do you think the GC numbers will go? what should we ask for? exemption for all??? not to mention that would get YOU a GC as quickly as possible and would LEAVE ME OUT. i still call and lobby for STEM exemption. i don't whine and moan on the forum about how it excludes health care professionals. if i have an issue, i work to resolve it- note the iv-physicians chapter in my signature that works to resolve specific issues. i created it and we have had success in reaching lawmakers with our problems.
anyway, iv is clearly not about a few leaders. the tone on the forums and the discussions are dictated by its members. iv has more EB3 members than any other category. so now ask yourself, WHY does the forum seem to discuss more EB2 issues (at least to you) ??? whose fault would that be if it were true? who needs to take responsibility to highlight their issues?
you have the option to change your job sir. if you are so frustrated, find a job that is up to your skill levels. you will not hear me on this forum complaining that EB1 should not get preference- hey i contribute as much or more. so why?

Your first post seemed asking only career wise successful folks who have patents/inovations and are affected by retrogression. I did write my story and then reread your first post, then thought to myself: my story is just similar to that Italian lady! The only thing different is she probably would have gotten her green card without much trouble, unlike my process.

First of all, It is funny that the guy who knowingly broke the law want help of law when he is victim. Now all of us know why laws are made in first place and why everyone should follow it.
Secondly, Beating the dead horse again, Thunderbolt should go to cops and give evidence of child abuse asap.
In terms of risking the case of hiring illegal for a job by going to the cops in my mind is a non issue. Because, he is exposed to that risk with or without going to cops himself. What if Nanny gets caught working illegal in some other home and she gives all names she worked for including thunderbolt. He has done a mistake and he should hire best attorney to plead that case if it ever comes up either by him reporting child abuse or some other way.

THIS INFO COULD VERY WELL BE CORRECT FOR THE MONTH OF AUGUST.
DOS allocates visa numbers for each month, for consulates across the world and USCIS here to adjudicate 485s. They provide these agencies with the priority dates for approval + a limit. This could have been used up for the month of AUGUST.
The spill over from FAMILY CATEGORY can only be used starting from SEPTEMBER 01 2008. Otherwise it won't go with the interpretation of the law.
Also the spillover from EB1 (for august 2008 and anything remaining for the current year) will be applied on September 01.
So, what this means is: The numbers available as per the visa bulletin for AUGUST is over. Does not mean, it's over altogether.
The theory does sound right but why will they wait to apply the spillover when the dates are current already abd it just moved 2 months in the August Bulletin for September dates

1. try to create awareness of her wrong-doing on social sites. Put the video, (if you like) on the sites.
2. Put a comment on the sulekha ad itself for this nanny (i dont know if you can do this).
3. Put comments on City search site. citysearch.com
4. Scare that woman away saying that you have found out that she is hitting the baby and you can complain to the cops.
this way we can make sure nobody else is hiring her as nanny.

I disagree with you. There are not FEW EB3 I people but MANY who are suffering! EB3 I is in 2001. Guys have been suffering for over 7 years. EB2 not more than 4 years (or max 5 years).
Who is retrogressed more? But guess what, EB3 is not as skilled as EB2 despite they are here for over 7 years and hence it is OK for them to part their family, go through retrogression pains more than others do, expose their career more than others do, pay more H1B renewals and EAd renewals (revenue for Govt) but get stepmotherly treatment.
The irony is over 15-25% (a very conservative figure) of these EB3 people are actually qualified to be EB2s!! It is just because of their employer/lawyer laziness they were filed under EB3.

04/06/2007: What Does Refund Checks from USCIS for FY 2008 H-1B Cap Filing Mean?
There are a growing number of reports from the H-1B cap filers beginning from late yesterday that they started receiving "refund" of filing fees from the CSC or VSC. These are the cases of the petitioners whose filing fee checks have been cashed by the Service Centers. We do not know whether this news implies that the USCIS has completed the job of sorting-out and data-enties for all the cases and the random selection process has commenced. Assuming otherwise, one wonders how they have decided that these cases have been not selected and the filing fees should be refunded. There are two theories as to how the random selection would be conducted. Obviously, the entire cases should be data-entried before they can start a random selection process. Otherwise, the random selection process will be not scientic and too arbitrary. But no one knows. One theory is that in order to make the data entries, they should take the filing fees and the payment of these fees will have to be refunded for those which fail to make it. Other theory is that the checks will not be deposited until the selections are made. Currently the process of random selection remains a mystery. However, the fact that refund checks started being mailed out may indicate that the first theory is more likely than the second theory, and there is a possibility that the random selection is made by the computer during the process of data entry rather than after completion of data-entries of the entire cases. Since they had only opened and sorted out a little over 34,000 cases, it may be hard to believe that yesterday they could have completed sorting out of the entire remaining cases in one day.
