You can call this also as jealous. There are too many people from the other countries will have to wait because not having people to mass migrate to US. Arguments can be made in way. So be sympathetic. Your issue may not an issue for me. Do not call it as jealous
What they are saying not jealous. According INA priority date in case substitution is the day I-140 is applied. Somehow the original labor date was assigned as priority date . This might be an error but is causing problems and Inconvenience and injustice to some innocent people. You can call it as jealousy. That is alright but they have an issue which they need to fight. From the following information:
1.Grant GC to all EB 2 / 3 class pimary applicants who have completed 8 years of continuous stay in the USA without any criminal record.
Personally, I do think the above bill you requested in the #1) is extremely difficult to work. It is because there was a bill proposed to the EB-2/EB-3 applicants to occupy the annual DV-lottery of 55,000 quota but it is NOT becomed a law yet. Now is April, 2011 and the DV-lottery results of this year will be announced soon online and the coming year of DV-lottery will be drawn again later during this coming Oct, 2011 but there is still NO hope to give those EB-2/EB-3 applicants into this DV-lottery quota. If this quota is occupied by EB-2/EB-3 applicants, less applicants will be in GC line.
Also, there is a proposed bill to allow foreign US accreditated universities' advanced graduates of STEM and with a US job offer to have GC but again it is NOT becomed a law yet. Also, your proposed EB-2/EB-3 applicants who have continuous stay of 8 years in US without criminal record to have GC may not fit the requirement of US needed because some of these EB-2/EB-3 applicants are NOT graduated in US universities and some of them are NOT in Science, Medicine, Engineering and Techology academic major which US society in demand.

OK first of all this proposed bill has no relation to the DV lottery neither does it have any relation to H1B visa. We are talking about the people who are stuck in GC queue for 8 years or more. Which means we are referring to people you started their GC application 8 years ago and still waiting in queue without knowing when their number will come. I hope this clarifies your doubts. Just because you stayed legally for 8 years does not/should not qualify you for getting permanent residency, you have been legally here and paying taxes for the past 8 years there by contributing to the economic growth of the country and this should be the reason why the US govt should consider you for giving you permanent residency. Thanks for the replies. I guess, I do not have time to get all that done before I file the I485. Damn, should have taken care of it earlier. I guess I will have to fill the forms just as I have done for the labor and then hope that I am not stuck. Will follow up with my lawyer to get some legal advice too. If I learn anything new, I will sure post.

Besides the initiatives that IV undertakes, to me, the next best thing about this forum is enthusiastic members like yourself sharing their stories on AOS interviews, H-1B stamping interviews, RFE/denials/MTR, Infopass, Travelling with AP/Port of Entry and anything else that can be a little nerve racking when you don't know what to expect.
I hope we all do the same for the benefit of this community.

Well said. Just think of this flower drive as a way to display our collective might to the media. What really shocks me is that most of us are tech savvy and yet we don't even see too many blog posts on this issue by the community of skilled, legal non-immigrants.

I heard from a friend who has a brother working in one of the lawyers affiliated with the AILA that USCIS has issued an internal memo to "go slow" on all EB 3 petitions including EB 3 I. That is very confusing to me given that EB3 I is U on the May VB. Has anyone else heard about this? if so can the IV core take measures against this discriminitory move.
Well - at the end of the fiscal year - their goal is to exhaust the quota. They have to exhaust the quota and they figured out that they have old EB2 approvable cases. As long as they exhaust quota it literally means there is demand - there is nothing much we can do - we are just stuck.
I request the entire community to unite and do something for ourselves. Admin fixes in form of preadjudication and recapture in form of legislation. Unless we do something for ourselves, as time passes - things will get more tough for us.

For us, life revolves around everything immigration. For IOs, its just a job to pay the bills. I wouldnt fault the IO...they are just doing their job & acting according to procedure. How many of us professionals keep track of EVERY SINGLE thing thats related to our industry. So keep that in mind while we criticize USCIS people.
If the company I work at, filed an intellectual bankrupcy and had become a big issue that I have to encounter in my day to day life, I would definitely remember that.

What I was saying is that if we take the majority of the posters who have responded / posted in this thread, we are seeing an overwhelming majoiry who support and /or sympathize with the pregnant girl. We are definitely not going to change our opinions and so are you. so let us stop this argument with a clear awareness that the majority of the posters are siding with the girl regarding the inhumane treatment delivered to her. We are not saying that we are correct but only saying that we are indeed the majority (thank God)

at some point the visa numbers are going to be all used up. The lucky ones would get their GC by then and the others will have to wait for a few months.
Why worry over it? The line only gets shorter and shorter and everybody will get their turn sooner than later.
As long as they don't waste any visa numbers, there is no need for any worry. Even their random processing order does not bother me that much, because demand for EB2 will be less than supply next year. Its time for EB3 to fasten the seat belts....
