Hi Everybody,
I would like to start this thread for the benefit of people who do not have a straightforward immigration history. In a nutshell, I hope in the future this thread will serve to provide information and advice on
Out of Status issues - Inconsistency with what's stamped in the passport and what you're actually doing
Unlawful Stay - Stay beyond the date in the I-94 card
The main focus will be on what these things can do to your i) AOS/CP filings ;and/or ii) future non-immigrant visas.
I came to this country because of a twist of fate and had zero knowledge of the immigration laws here. Through the school of hard knocks, I have gained considerable knowledge about this convoluted process that affects us all and hopefully what I learnt will be of use to other people in the same boat.
A special mention goes out to "unitednations" for his skill and knowledge about various issues. Thanks buddy, you're a huge asset to all of us.

Leadership-
Most of the senior members and Admins either have left IV or not able to spend enough time together to plan and organize action plans for the community. This is what I feel we are missing. We are acting alone although we are part of community.
We need to come together and keep ourselves focussed on common issues related with congress bills, retrogression, IV Agendas and road-map for coming months or years.
I mostly see pappu from core IV leadership. Where are other folks. If current leaders cannot lead us in the future, we need to find someone who could.
Again, my intention is not question anyone's hard work, but I am not seeing the same momentum and focus we had year back.

Five years ago, Yiyun Li had a problem: How do you persuade the literary world to take you seriously when you're a 28-year-old native Chinese speaker trying to write in English, you've published exactly nothing and your training consists of a single adult-education class?
Since then, the Beijing-born Li's career arc has been so steep it gives her peers vertigo.
She's had stories published in prestige magazines such as the New Yorker and the Paris Review. She's won the Pushcart Prize and the Plimpton Prize for New Writers. Random House has signed her to a $200,000, two-book contract, which Executive Editor Kate Medina calls -- in what qualifies as a serious understatement -- "most unusual" for a literary writer at this stage of her career. Her first book, a story collection called "A Thousand Years of Good Prayers," was published this fall to wide praise.
Now she has another problem: How do you explain to the federal immigration bureaucracy what the word "extraordinary" means?
n the summer of 2004, Li petitioned the U.S. Citizenship and Immigration Services to become a permanent resident of the United States. To approve her application for a green card, USCIS would need to agree that she was an artist of "extraordinary ability," defined in Title 8, Code of Federal Regulations, Part 204.5(h)(2) as "a level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor."
To the upper echelons of literary publishing, Li looks like a slam-dunk to meet this definition. Not to the USCIS, however. A year after she filed it, her petition was rejected.
She has appealed. A USCIS spokesman says she is likely to get her answer in a few weeks.

I remember the suggestion from Pappu to call Senator's and HR's instead of writing or faxing. Clearly the last campaign had pretty strong support from IV members. Can we do the same thing and call ATLEAST 2 friends by end of week and convince them to contribute? I pledge to convince at least 10 friends by end of this week. .

I don't think one's profile has anything to do with one's posting. May be he did not want to share his profile. In any case, if someone puts a believable profile, but posts some fake story, does that make the post a genuine one?
Ching is posting just what he experienced at the CIS office. Having said that, I am not saying what he posted has absolute truth to it. But on the otherhand, the way CIS does things, would anyone be surprised? With all the past experience we have had with CIS and DOS, anything is quite possible. Yeah, now it's not only frustrating to deal with CIS's ways of working, but also even more frustrating when we encounter posts like this whether they are true or not...

I read a posts by you all on immigration voice which said U.S newspapers can easily publish a name change Ad for $70!! But I hear that they need some kind of a court order to do that...Can I ask you which paper did you advertize in India and in U.S. I have the same problem as many others -- I have only one name on my passport "Kritee" and U.S. embassy when they gave me visa made it FNU (as first name) Kritee (last name). Now I want to add a first name to my passport and all documents in U.S...and am wondering if I need to go to a U.S. court or not? All and any help will be appreciated!

(Given name: <middle name><first name>).
so while applying for the visa, they ask for first and middle names (as present in the passport)
Do I need to give the name as it is typed in the passport or can I give first name and then give middle name. Will there be any problem by rearranging the given name in the visa application?

Sometimes we get approached by journalists who need a story the very next day. They are looking for specific subjects for the story though.
An example is say the Investors Business Daily (a financial daily). A reporter might come to us and ask us if we have anyone from the Finance sector who is suffering due to retrogression and is willing to speak up about it. They might also add that we need only Eb1/Eb2 category folks.
When this happens, we are in a mad scramble to find folks who fit this criteria so that we do not lose this chance.
Another example might be of a Medical Journal looking for doctors stuck due to retrogression.
We are constantly getting requests like this but cannot capitalize on it because we do not have enough stories already available to fit the criteria.
So please send in your stories. It need not be earth shattering at all (most of us are mere mortals). You never know when a reporter is specifically looking for a story similar to yours and you might just tilt the balance in favor of skilled immigrants.

I haven't been called for an interview yet, and I hope things remain that way. But I have to thank you for taking the time to share every little detail of your AOS interview. Besides the initiatives that IV undertakes, to me, the next best thing about this forum is enthusiastic members like yourself sharing their stories on AOS interviews, H-1B stamping interviews, RFE/denials/MTR, Infopass, Travelling with AP/Port of Entry and anything else that can be a little nerve racking when you don't know what to expect.
I hope we all do the same for the benefit of this community.
