    First of all hiring someone on tourist visa was illegal, You had not thought about the safety of your child while doing it and without proper background check or reference checks hiring someone for nanny or anything like that involving children can be risky. There are instances of abuse which certainly will go un noticed.

    From a legal perspective, Did u have a written contract for nanny, even if you sue the person you might not be able to recover anything and hiring an illegal may land you in trouble.

    Kinda agree on the lack of momentum. One indicator being that IV hasn't been "In the news" since Sept 11 2007......a year back!!... This is from the IV website.

    Would you help us compile all the news stories since then for the website. We just never had the time to compile them and post. There have been several stories about IV since then.

    Anybody else want to take the same challenge as mine, if we achieve the 60000$ target by Dec 31? 20$/month contribution is not BIG at all.

    If my wife who is an MBA finance from Mumbai, currently working as a corporate banker with one of the top 5 banks in the world comes to the US on an H4 & decides to do a CPA certification, can she work on OPT until the H1B quota opens up next year???

    It will be ok as long as they give her an F1. Here is something from a website -

    Eligibility for OPT

    OPT must be in the field of your declared or intended major. The relation can sometimes be fairly loose; for example, a math major would often be relevant to a business job involving statistics, analysis of data, financial figures, etc. The determination is up to your employer, but they are well advised to be cautious. In case of doubt, it might be good for them to insert a mention in your offer letter subtly mentioning your major as being relevant to the job.

    Your employment must be commensurate with your educational level; for example, cooking fast food would not be commensurate with a completed Business major.

    You must have been in F-1 status at some point for at least 9 continuous months as a full-time student, not including high school. These 9 months can include summer vacation; one summer plus one semester might or not be enough. These 9 months can include time as a student in J-1, J-2, or other appropriate status.

    Guys,
    I applied that way. I had to take the letter of completion from the school. Luckily I had a research credit to which I got a grade for and it completed my degree requirements. So I got the letter from the school as my lawyer said that I could not file for H1B Masters cap otherwise.

    They had filed me for the 65000 regular cap before but they told me that I could apply for the Masters cap only if I have the letter, I got it from the school.

    But there is a catch here. Due to all this I have two different dates on my OPT and H1b for finishing up the requirements and hence my OPT is bound to get rejected I think since it would be saying that I graduate in May and my H1B would say that I finished in April.

    Trying to figure out if there is a way to stay here in US without having OPT. or else go back and get the visa stamped.

    What exactly is meant by checking the receipt date online and it is 3 months after the date in the paper? All I see on my 485 is a statement that they have received my response to the RFE...I don't see any receipt date or notice dates on the case status online at USCIS.gov

    Just wondering what you mean or am I missing something?

    What Sanju posted is not off the mark. And I agree with Wandmaker. The person who came up with this idea needs to PM or e-mail Pappu or Administrator and get some feedback if IV Core supports this. If you get the yay from Pappu, then form a small core group who will tacke the operational aspect of this idea and keep it moving forward. The "posts" need to be coverted to "actions". I am just speaking from experience having run a successful year long campaign with IV already. Best of Luck!

    Hello guys,
    Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.

    We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
    She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else’s small babies. She it seems had come here last year and taken care of someone else’s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
    I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old – who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child’s safety every day.

    Thunderbold, Sorry for your situation. Here is my observation/suggestion.

    Being an immigrant you have broken the law by hiring someone to work illegally. Didn't you and your wife break the law?

    You have already witnessed a child abuse and now pondering whether to report this to a law enforcement or not. Again you are breaking the law by not reporting a child abuse. Remember, abetting a crime is also a crime.

    This country has given us so much including good wealth and health(except GC) and we enjoy every thing, but in return what we do is to do these kind of illegal activities.

    This country let us and our spouse to work, make hell lot of money. I am not saying we are making easy money, but after having two incomes, we run around with coupons and look for cheap things or do things that are cheap. WHY?

    What are we going to do with that money man? This is nothing but a greediness.

    Anyway, your child has gone thru a nightmare and as a parent/father you MUST report this to a law enforcement office. You can not let this child abuser go scot-free.

    Note: When you can hire a nanny that is legal/citizen for $350/week, then why did you hire someone illegal?

    I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.

    While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.

    These are my thoughts!

    Your story is VERY valuable. We still have a zillion media outlets to work with, and we absolutely absolutely need your support. For this particular one we were working with, the reported has been very very specific and narrow in what was needed, and therefore we picked other subjects. In any case the idea is to make most of any given media opportunity :-)

    Hang tight, we have a long ways to go, and many other battles to fight. We need you to be ready for them :-)

    These should be USCIS rules like IRS rules. Everyone should be entitled to see them like IRS rules.

    If you have 140K visas, how many go to
    EB1
    EB2 ROW, EB2 India, EB2 China, EB2 phillipines
    EB3 ROW, EB3 Indian, EB3 China, EB3 Phillipines?

    What happens with EB1 has unused visas? How do they flow?
    What happens with EB2 has unused visas? Where do they go?
