My wife got her name changed on the passport last week from the DC embassy. Her original Indian passport had only her first name and her last name was blank. Her US documents (Visa, SSN, Drivers License, etc) had her name as <first_name> FNU (Family Name Unknown). For a passport name change, the Indian Embassy requires you to:
1. Create an Affidivate in India saying that the name needs to be changed from <first_name> <blank> to <first_name> <last_name>.
2. Publish the name change in a national newspaper.
3. Publish the name change in a local US newspaper.
Along with the name change application, you have to submit the original affidivate, the paper clipings of the Indian newspaper and the local US newspaper.
Alternatively, if you have a marriage certificate and the marriage certificate lists your name as <first_name> <last_name> rather than <first_name> <blank> (as on your passport), you do not need the affidivate and a copy of the marriage certificate is sufficient.
The renew/change-passport-by-mail service that the indian embassy provides will take 10-12 business days (excluding Indian public holidays :) ). If you go in person to the consulate/embassy you can get your passport back within 3-5 days.
Atleast as far as I know, the DC embassy doesn't have any same-day service(don't take my word for that, I could be wrong). Good luck !

please refer the dates before posting such useless information. very ashamed to see some donors do this kind of mistake. unnecessarily misguiding the people. for a moment i lost hope. if this time, the uscis (after all the preadjudication numbers and all) makes this kind of stupid mistake then the USCIS should be ashamed of its existence and DHS should shove its head in some uselss thing.

However, I am afraid that we will see dates retrogress again in oct. why? because I don't see a lot of people getting their I 485 approved. There are several eb2 I cases here and in that are current and haven't been approved . You would see a lot of celebration on this site if people were getting approved .

That validates my reply previously to a posting by a guy who said that he had called up TSC and they said they go by RD...I had asked him to call back after a day and he'd get totally opposite info.
My situation is the same.....I was TSC-CSC-TSC....but I had received an RFE last year.....dunno why will they preadjudicate and then go by ND which is totally non-sense...logic should be that if a case is preadjudicated it should be put on based on PD..
Again USCIS don't follow any logic...
As I said b4 very few transfer cases will ever get approved.....just bid your time...or apply thru EB1 chances are better that way..

I am not trying to question the dedication of the folks here, but I have not see any plans or goals set for this year.Is this because of election year?
The site has become one more forum site to discuss personal issues and to vent out our immigration frustrations.We seem to be losing momentum on the larger effort of Visa Recapture or even looking forward for any new bills? Well even if we consider that there would be a change in white house, doesnt the senate and house still be intact with the members.
Does IV work with CompeteAmerica or any Lobbying group which could help us with direction?
Just my thoughts for the day.

Here is another story. My spouse has been working for the same firm for 7 years now. After finishing her Cost Accountancy in India, she received MS in Accounting and MBA in systems management from a top B-School in the US. Even then, her case was filed under EB-3, after a two-year wait because her company does not immediately process GC for newcomers. Her case went to the Dallas BEC for LC clearance in 2003. After that we haven�t heard a peep from the Dallas BEC. Her lawyers, one of the top law firms in the county, are not helpful at all. They wouldn�t tell us our case number so that we can check the status ourselves or tell us what they are doing to pursue the case. Apparently, the company has been burnt by employees who have left the day after getting their GC. Hence, the Law firm�s motto is mum and the HR department in the company is not doing very much to assist. Besides assuming that miraculously the LC is approved, the EB-3 for India is so badly retrogressed�well, we feel hopeless. Moreover her company has a bond agreement, if anyone leaves before completing 2 years of full-time service after receiving the GC they have to pay a fine of 10 grand. Her job involves extensive travel, which is really putting a strain on our family. However, we are in no position to change jobs, even within the same firm. I can apply, but then, it is another 6 grand for processing and I will be way back on the line, and the standards for EB-1 is so exacting and the paperwork required is so daunting that it will take months to get all the paperwork and letters together. And, my school is not very enthusiastic about sponsoring people under EB-2. Anyway, what�s the point of filing under EB-2 now?

I'm not sure if I'm eligible to apply for Master's quota. I'm done with all my degree requirements and I've scheduled my thesis defence on MAy 20th. Is it still possible that I can apply in Master's quota. I've a letter from my schools which states that I'm done with all my degree requirements and I'll be finishing thesis on May 20th. Is this letter enough to apply for MAsters??
since master's quota is still available, you can apply now. some lawyers say you can apply with that letter from school.Later if you get RFE you can submit your masters degree at that time. Anyways talk to your lawyer

How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".
EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.
You are critizising H1B indians and their employer screwing the system which is not relevent to what we are talking here. If you feel so, then attack who ever spoiling the system and regulate those. Instead you are trying to justify your interperataion is right and what DOS is doing is right. at some point the visa numbers are going to be all used up. The lucky ones would get their GC by then and the others will have to wait for a few months.
Why worry over it? The line only gets shorter and shorter and everybody will get their turn sooner than later.
As long as they don't waste any visa numbers, there is no need for any worry. Even their random processing order does not bother me that much, because demand for EB2 will be less than supply next year. Its time for EB3 to fasten the seat belts....

I was hoping the date to be somewhere around March 2005. That would have taken care of all Backlog Elimination Center cases.
- Current dates show that there were a lot of BEC cases to be approved.
- Now, dates might struggle a bit to reach April 2005.
- Dates should move faster after that till end of 2005 as there were very few cases that went through PERM in 2005.
- Again, in 2006 the Dates might move slow till......we reach last FY month overflow in Sept 2010.
- Current dates show that there were a lot of BEC cases to be approved.
- Now, dates might struggle a bit to reach April 2005.
- Dates should move faster after that till end of 2005 as there were very few cases that went through PERM in 2005.
- Again, in 2006 the Dates might move slow till......we reach last FY month overflow in Sept 2010.

I also personally think the lawsuit is the better way, especially in the election year.
It can produce one of the three results:
1> We Win... Everything is fine.
2> We Lose... At least the thing got settled and it is clear that the US can create discriminatory laws.
3> Force Congress & the US govt. to expediately state its stand & justify the stand on the per country quota limit in employment based immigration.
Everyone, I talked to including some lawyers, especially after 9/11, thought that nothing could be done about FBI check ups. But guess what, the courts decided in favor and required that FBI check ups be done in 6 months.
Second case would be about Guatanamo Bay prisoners. Even there, the courts decided the prisoners were protected by the US human rights laws.
The good thing about the US is the case gets settled/decided ASAP, and it would make sense to give the lawsuit a try.
