    Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
    So having said that, am I in Status or Out of Status?

    I would think that you are out of status for those 3 months, because one of clauses of the of the employer-employee relationship, governed by your employment contract, was violated (by you not being paid.)

    Your employers ability not to pay, is not your fault. If/when you file for your 485, have your lawyer draft up affidavits to this effect. I am not a lawyer, consult a good lawyer for the best advice.

    Dear QASleuth, I have contacted Pappu and asked him to discuss this among CORE and provide us an official IV position. Once we hear back from Pappu or CORE, we can proceed further.

    Regarding what I am planning to do: If we get IV CORE's support, I will try to organize a group from St Louis MO to work on this. But we need an excellent bunch of folks from the DC/NY area who can actually meet folks at the capital and get the ball rolling. All others who are far away from DC/NY area can form small regional groups to raise funds to support the DC/NY group which will drive this effort.

    We should do something only after IV CORE's analysis of this issue and a legal feasibility study by immigration/constitutional attorneys IV can access.

    QASleuth and others who would like to do something: Please don't wait for any action from my side. You can form regional working groups now itself. Just form members of 5 and discuss this and stay in touch.

    I am new to this whole effort as anyone else here.




    Once again friends, as I said earlier: "We have far more things that unite all of us than the few things that divide us. So, let us focus only those things that unite all of us."

    So, please refrain yourself from pointing fingers at someone else and attacking someone personally.

    I am hoping realizeit is in the process of contacting IV core and will update us soon. If not, realizeit please update as to what you are planning on doing.

    After IV core gives us the go ahead, I think we should take your offer on the bridge call.

    I would also suggest, not sending any mails yet to Ombudsman till we form a plan of action.

    Ofcourse, still eagerly waiting for desi3933 to get back to us with cold hard analysis to set us straight :)

    1. documented / undocumented is a matter of immigration status..... no human can be illegal..... an activity can be illegal which makes a person undocumented...... as defined by human law...... but above human law there is another law..... which is defined by an entity more or less we all believe in..... how can a new born child.... a creation of the creator be illegal? delivery of a child is not just a matter of mother.... its a matter of another life being brought into this world..... how can that child be illegal?

    2. even felons are not shackled to bed.... unless someone is danger to others..... how can a pregnant woman just about to deliver a child be danger to anyone else.....

    3. i lost my wallet few days back.... anyone could lose their wallet sometime or the other ..... it happens..... and during that time we are all driving with a license..... does it mean we all must be shackled to bed when delivering a child......

    4. unpaid driving fines?? big deal.... obama had unpaid tickets.... which were paid just before announcing presidential nomination.... majority of the people voted him to become the president..... but according to you..... its ok to shackle someone when delivering a child if that person had unpaid tickets..... nice....

    for anti immigrants...... we all r no different than undocumented..... anti immigrants want all immigrants to be thrown out..... period..... u may think that u'r better than undocumented..... & somehow its ok to treat someone inhumanely becoz of their undocumented status.... but the types of that deputy of sheriff joe will not hesitate to do the same to u (if u r a immigrant woman with legal status) ...... or to ur wife (if u r wife is an immigrant woman with legal status)..... they will just make up for the reason .... like resisting arrest..... attacked officer at the time of arrest.... blah blah blah .....so don't pretend that u r any better than that undocumented woman..... becoz u r not........

    Thanks deecha for your response , I am sorry that i was unable to frame the question properly.My question is traing period (July 1st 2004 to Aug 30th 2004 = 60 days) without pay on H1B is treated as Out Of Status??? Is this period(July 1st 2004 to Aug 30th 2004 = 60 days) counted towards 180 Days period (to be covered under 2445(K)) or not?

    For a new H1B, a grace period of up to 60 days is allowed before you can start work after entering the country. However, you were already in H1 status and this was a transfer and If you did not get pay stubs for those 60 days, then unfortunately for you, my friend, you were out of status and this period would be counted towards it. There might be other mitigating circumstances you could use to qualify those 60 days as "work" for your employer. You will need to consult a good lawyer and be on good terms with your (ex ?) employer and have his co-operation. If you're in Michigan, I can recommend a good lawyer. PM me.

    In my case (see above), I inadvertently left the country in '04, without realizing I may not be allowed back in (I did not even have AP) and I also got lucky on two counts i) My employers petition was approved in just 13 days (non-premium processing) ;and ii) I was able to get a visa stamp in home country without a visa interview (but that scheme was terminated the same month due to other consular concerns).

    I am going to take the liberty of putting together an agenda for the conference call, just to make it more productive. I can play scribe for the call.

    The call will be for a maximum of 60 mins, unless someone wants to take it longer than that.

    2. Volunteers who want to be part of the smaller sub-group need to come forward. -- 5 mins
    This is purely to get thoughts/ideas streamlined. Everybody needs to chip in once the action plans are drafted.

    It is good to analyze. But pls let us be together.
    There are several who's category was determined by the employer and their lawyer and an equal number, who have no clue as to what is actually the content of their labor. Myself for example, was never allowed a glimpse of the labor application, only know that it was approved. i also do not have a hard copy of my I140.
    The positive point is this year, major channels are talking about Legal immigration much more than i have heard before.
    let us work together to highlight the broken system, the only way it can eventually get fixed by our direct efforts.

    I just want to generate enough internet chatter so that the issue of substitute labor will come on CIS radar. I know for sure that a huge fraud was perpetrated during July 07 fiasco by some unscrupulous consulting companies who sold pre-approvevd labors like frozen pizzas. Just heat and eat.

    And I also know for sure that IV has gained enough publicity that CIS folks might be tempted to check it now and then. May be they will take notice of this thread and start investigation of all the subst labors.

    I surely am pissed as hell on somebody who came to this country in 2007, and got his/her GC by paying money for some 1999 pre approved labor. I will fight on.

    I think you should consider accepting stories of those you have yet to start their GC process. This gives another perspective, to tell people that even those who are highly qualified and experienced are in two minds whether to file for GC or not. Why this thought? this is because the delays and long wait acts as a deterent. End of the day, if these people are already frustrated at the onset, then they may decide to leave US and seek opportunities elsewhere, leading to loss of such valuable talent to the US. This was explicitly highlighted in yesterday's Judiciary Committee presentations by the four Economists.

    While accepting stories from those waiting for GC, please also accept stories from those who are apprehensive of filing due to the delays, hence conveying a reason that US risks losing highly skilled workers should these circumstances continue.

    These are my thoughts!

    Your story is VERY valuable. We still have a zillion media outlets to work with, and we absolutely absolutely need your support. For this particular one we were working with, the reported has been very very specific and narrow in what was needed, and therefore we picked other subjects. In any case the idea is to make most of any given media opportunity :-)

    Hang tight, we have a long ways to go, and many other battles to fight. We need you to be ready for them :-)

    my reply was only meant to highlight what you have been doing on this thread. i do not care who is in which EB category. and i know exactly how people with masters degrees suffer in EB3. however, for you to argue that all category preference should just disappear, is quite ridiculous and i have explained the reasons to you. that does not mean people in EB3 are not suffering or that all those in EB3 are either holding advanced degrees or 3 year bachelor degrees. that stereotyping is in your head alone. certainly not in mine. you never answered any of my questions though. what would be the effect of YOUR solutions? would people like me EVER get a GC?

    please do not unload your frustrations on all of us and derail what should be important.

    iv has one goal- to end retrogression. period. iv's founder belonged to EB3. so do several core members. you have some funny perception that iv is about EB2. so be it. ironical though, because iv is commonly accused of being an entirely EB3 india organization.

    so let me hear how the following things iv has constantly been fighting for, are somehow not helpful for EB3??

    recapture GC
    exempt families
    remove country quotas

    as for STEM exemption, if EB2 clears up, where do you think the GC numbers will go? what should we ask for? exemption for all??? not to mention that would get YOU a GC as quickly as possible and would LEAVE ME OUT. i still call and lobby for STEM exemption. i don't whine and moan on the forum about how it excludes health care professionals. if i have an issue, i work to resolve it- note the iv-physicians chapter in my signature that works to resolve specific issues. i created it and we have had success in reaching lawmakers with our problems.

    anyway, iv is clearly not about a few leaders. the tone on the forums and the discussions are dictated by its members. iv has more EB3 members than any other category. so now ask yourself, WHY does the forum seem to discuss more EB2 issues (at least to you) ??? whose fault would that be if it were true? who needs to take responsibility to highlight their issues?

    you have the option to change your job sir. if you are so frustrated, find a job that is up to your skill levels. you will not hear me on this forum complaining that EB1 should not get preference- hey i contribute as much or more. so why?

    get with it. we fight the battles we think we can win. ANY GC numbers/exemptions will move everyone ahead in the line. what part of that do you not understand?

    and now again. stop this divisive crap. we have more important issues to deal with.

    Given that you are the super moderator, how can you even hint that EB3 vs EB2 reflect skill level of employee - don't you know by now that category is determined by "job's Requirement"?!!!!!!

    Also your stereotyping of all EB3s as 3 year Indian degree holder is the most unfortunate - I only hope that rest of the IV leadership is not made up of that crappy idea.

    For the record, I hold US Master's degree and am really offended by your comment and your view point.

    For the rest of the members reading this topic, this is exactly why being EB3 on IV is becoming more frustrating by the day... especially when the super mods posses such views...

    i cant believe USCIS is acting like some cheap ass organization. they generate billions of dollars of revenue..and they want us to pay 5K to develop a software to sort their database.
