I am new to this forum, so I am joining this tread.
Hello,
I worked up nerves to consult with the forum.
Please read my history and answer questions below.
Your non-judgmental and objective answers are greatly appreciated.
I first came to the US on a tourist visa when I was 15 years old.
I was out of status when my parents couldn't act fast enough to change my status. However, I faithfully maintained my status once I reentered with a student visa.
So here is the history:
Dec. 1986: Enter the US on a tourist visa (age 15)
June 1987: Out of status from the tourist visa for 10 years
Sept. 1996: IIRIRA 96 passes-- 3yr./10yr. reentry bars apply effective April 1, 1997
July 1997: Obtain I-20 for school, leave the US and return to home country (age 26)
Aug. 1997: Reenter US on a F-1 visa
Oct. 00: Initial H-1B
Oct. 03: H-1B extension
Dec.04: RIR filed (priority date)
Sept.06: RIR approved
Oct. 06: H-1B (7th year) extension
Jan. 07: I-140 filed (pending approval)
July 21, 2007: Preparing to file I-485 with the same employer since 2000
So here are my questions:
Q1. The way I interpret the law is that the 3yr./10yr. reentry bars apply when the law went into effect starting April 1997. Is that correct?
Yes that is correct
Q2. If so, would I have to worry about getting the I-485 approved?
I woudln't worry. You have a valid i-94 and have maintained status all this time
Q3. If not, should I filed for I-485 at all?
You have nothing to loose by filing
Q4. Any suggestions or possiblities to consider?
Did you hand in your first i-94, when leaving the country after overstaying for 10 years?
Thank you.
Hope this helps.

Guys & Gals,
Let no one take you for granted. Stand up now for what is important to you.
It is time to debunk all the negative myths about the high skilled legal immigrants.
Be part of this historical event which will go down as a memorable story in the
legal immigrant community. Be part of this amazing experience.
Yes, you could always watch the rally on TV but its time to book the air ticket,
take the bus or just take your car out for a long drive. Bring along your family,
spouse and friends.
Yes, together we can do this. See you in DC.

Alright this was not even a 1 mile marathon before you guys gave up.... With this rate even half way mark looks so away ..... come on people only this much fuel is left in your torso.... :p :p
Yeah now I have understood that why you guys won't win your GC cause..... because you cannot even beat me at a simple $1000 challenge ...how would you beat Senate , House and those millions of anti immigrants dollars .......
Keep watching this thread and do not contribute..... you will end up in the same position at work and see everyone else run over you.....

Thank you IV Core. You guys are awesome.
We should also thank the CA Congress woman and USCIS for making this happen.
We should show our gratitude to the congress woman and all others who the core team thinks are worth, by some means for championing our cause.
I will be sending another $ 100.00 to IV shortly.

I am a bit surprised that you had to do a crazy search for a third person. I did send you guys my story. I am non-IT EB1 and I did get an initial phone call from Sunil but then did not hear back.... Any way good to hear that you did find the necessary people.
Guys,
We were approached by a award-winning reporter to provide her two members of IV that fit two criteria
1) Should be non-IT
2) EB1 or EB2
Given the 20 stories we had only 2 such folks that fit the criteria and they who were gracious and spoke to the reporter. The reporter then wanted to speak to one more person and we did not have any readily available person. So we had to do a crazy search for a person that fits this criteria. We were able to find someone at the last moment and we did not squander our chance. But chances are pretty high that such a thing can happen in future!

can pre adjudicated files also be sent to review or is it only to files that are not pre-adjudicated but are trying to pre-adjudicate
the biggest stress is the window of opportunity is so small that the stress levels are going to be high. if not now then we have to wait for another year. for the first time in my life I can see why our elders used to give up on government activities and why they say have patience. here with uscis it seems like years are passing by like eons but uscis asks us to consider them as minutes or seconds.
one of the ridiculous person at uscis when asked why i am not getting my ead in 90 days says this - sir there are people still waiting from a year to get their green card so please have patience and consider yourself lucky that it is just 90 days. what kidn of a screwed up person give such a response.
seems like we have to go through this painful month once again. lucky people will get their green card - unfortunate ones will have to wait for however long it is

Ok, been thru this also recently.
As these days your photo comes printed in the passport unlike those old days when they used to affix the photo with gum. Hence, the new size 3.5 cm because i think they scan it and computer prints it.
To answer your question, at NY the correct size is 3.5x3.5 cm.
However, they are accepting 2x2's as well, but the downside is the computer cuts it to 3.5x3.5 cm hence showing ONLY your face without a little bit of neck or shoulder. This photo does not look good, i have seen this happen with the same guy that i mentioned in the above therad.
I took both 3.5x3.5 and 2x2, they didn't care, but i gave them 3.5x3.5 as it was stressed in the NY webpage.
Now, getting 3.5x3.5 cm photo is a PAIN. I went to PicturePeople and I had to find a really smart guy to do that job for me. At the counter, they just plainly refused to do that.
Thanks a bunch for the info. I will now go get the 3.5 cm.

If it is just a name change from maiden to married (i.e. change in surname) you don't need a court order. All you need is your marriage certificate and a notarized affidavit to change the name on the passport.
Hello,
I am also trying to go through the process of getting my spouse's name changed. I got good information from all your posts, but I am trying to understand the order of steps to be followed:
So,
1. Place ads in newspapers in US and India
2. Get the local court order
3. Mail all the required docs to respective Indian Embassy in US along with court order
4. Once passport received with new name, use the court order and passport to change names in SSN, drivers license etc.
5. Once all of them are changed, send all copies to USCIS (New name will be applied with next stamping and for now we ll still carry old and new passports pinned togther)
Please let me know if I am missing something and any details if possible.
Thank you

If less than 20,000 MS H1B applications were received on April 2, what will be the rules of the lottery? Will all those whose applications were received on April 2 be guaranteed a H1? In this case, will lottery apply for April 3 and April 4?
